Evropský soudní dvůr prohlásil, že italský profesionál Teamu PokerStars, Paolo Fabretti, nemusí zaplatit daň z příjmu ze své výhry €52K, kterou si připsal na IPT High Roller eventu ve Slovinsku v roce 2009.<\/p>

Italští státní příslušníci nejsou daněni za výhry, které zaznamenají ve svých vlastních národních kasinech za předpokladu, že již zaplatili tzv. daň ze zábavy (entertainment tax; pozn. překl.), ale italská vláda považuje cokoli vyhraného v zahraničí za zdanitelné, takže uháněla Fabrettiho a dalšího turnajového profesionála, Christiana Blanca, dohromady kvůli nepřiznaným výhrám ve výši $676,000<\/a>. <\/p>

Oba grindeři se odkazovali na to, že daňová výjimka v Itálii není fér, jelikož \"se nevztahuje stejnou měrou na každého.\"<\/p>

Navzdory argumentu italské vlády, že zákon je v platnosti, aby zabránil zločineckým syndikátům v praní špinavých peněz v zahraničních kasinech a také, aby reguloval problémový gambling, rozhodl soud se sídlem v Lucembursku, že současný zákon neplnil úspěšně ani jednu roli a ve skutečnosti omezoval volný obchod v zemích EU tím, že omezoval italské hráče, aby se stěhovali do zahraničí.<\/p>
