Alderney Gambling Control Commission (AGCC), regulační orgán, který licencoval Full Tilt Poker během jeho provozu, právě oznámil<\/a>, že dne 3. května se bude projednávat žádost Orinic Limited o licenci elektronického hazardu kategorie 2.<\/p>

Orinic Limited je dceřiná společnost Full Tiltu, která v minulosti vlastnila aktivní licenci AGCC. Její licence byla koncem září loňského roku pozastavena, včetně zrušení všech AGCC<\/a> licencí držených FTP. Orinic zažádalo<\/a> o novou licenci kategorie 2 23. března.<\/p>

Z jakého důvodu je toto slyšení nutné?<\/h2>

Abychom plně pochopili, proč se toto slyšení koná, je nutné nahlédnout do Regulace 23 z Alderney eGambling Regulations, 2009<\/a>.<\/p>

Regulace 23 stanovuje, že kdykoliv někdo podá oficiální posudek na nového žadatele, \"patřičně oprávněný úředník Komise informuje zastupující osobu, zdali si přeje učinit slovní vyjádření před Komisí během slyšení, nebo se spokojí, když vezme Komise v potaz jeho námitku.\"<\/p>

V tomto případě musel někdo zvolit slovní vyjádření během slyšení.<\/p>

Mluvčí AGCC vysvětlil PokerStrategy.com, \"že takové slyšení ještě neznamená, že byla proti žadateli nějaká námitka vznesena - jakékoliv vyjádření třetí strany nebo posudek bude vzat do úvahy. Účelem slyšení je, aby Komise takové posudky obdržela.\"<\/p>

Jak to probíhá?<\/h2>

Pravidla slyšení, jak je uvedeno v Sekci 3 Regulace 23, jsou následující:<\/p>

(a) osoba vznášející námitku přednese svou stížnost a žadatel na ni bude reagovat;<\/em><\/p>

(b) patřičně oprávněný úředník Komise má právo pokládat oběma stranám otázky;<\/em><\/p>

(c) strany a patřičně oprávněný úředník se mohou dostavit osobně, nebo mohou vyslat jakéhokoliv svého představitele;<\/em><\/p>

(d) Komise se může ptát jakékoliv strany zúčastněné při slyšení.<\/em><\/p>

Na otázku, kdo se slyšení zúčastní, mluvčí odpovídá: \"Přesné informace nebudeme mít až do samotného slyšení. Pokud se strany neúčastní osobně, Komise musí vzít při rozhodování o vhodnosti žadatele i tak do úvahy názory vyjádřené veřejností.\"<\/p>
