Februar 2015 ihre Revision zur&uuml;ckgenommen. Die Kl&auml;gerin, die staatliche Lottogesellschaft von Nordrhein-Westfalen, hat dem nicht zugestimmt.<\/p><p>Ihre Unterlassungsklage hatte in den Vorinstanzen Erfolg. Trotzdem nahm der Bundesgerichtshof die R&uuml;cknahme an. Ein Gesetz, dass die Revision nicht mehr einseitig zur&uuml;ckgezogen werden kann, ohne dass die zweite Partei einverstanden ist, gilt erst seit 2014. Weil die erste m&uuml;ndliche Verhandlung aber bereits 2012 stattfand, greift es in diesem Fall nicht.<\/p><p>Weiterhin weist der Bundesgerichtshof darauf hin, dass der Gl&uuml;cksspielstaatsvertrag in einem weiteren Verfahren am 12.
