      the opp is looks fishy 74/40/fld 3bet 0/fld cbet 0/43 hands better to check/fold this flop against him ?

      Preflop: 3-bet is fine for value versus fishy player, although I may make it smaller (3x) to leave more money for postflop where our biggest advantage is.

      Flop: If we think we have enough FE (and we need him to fold about 1 in 3 hands) we can bet here. I feel that against unknown fish we have to bet here with what will most likely be the best hand.

      Once the 9 hits the turn that improves part of his calling range (and does not improve our hand) so we would have to fold.

      That fold to cbet stat is not very useful unless we know the sample it's over (next to the stat you usually have a number in parentheses that tells you the sample for it). Based on the fact that you only have 43 hands on him i can't see that sample for fold cbet being too big.
