      fold to 5bet 5 in 9

My initial idea was to 3bet/shove, but since he made 4bet so small and since we are 108bbs deep, I decided to min 5bet with the plan of calling a shove, I think my 99 is good enough to do that. When he calls I actually can see him calling with marginal hands thinking he has good odds so I thought checking flop was best.

You 99 is borderline good imo, definitely one of the weakest hands I'd do it with but still +EV since he is a regular that should assume you are capable of 5betting to fold when stacks allow it. Ofc, you sometimes flip and quite some of the time you are behind but given preflop odds, and risk/reward with the 5bet I like it.

Postflop, I am not really sure what to make of it tbh because I have not played that many 5bet pots. :D I think check/shoving cal look like a draw but then again check/calling will look like a JJ type hand. I think check/calling should be quite good but in general the difference between all your options should not be big. If he has a reasonable piece he is not folding and he is unlikely to try and bluff you if he wiffed.
