L'iPhone, un'arma inconsapevole

Era stato colto con le mani nel barattolo della marmellata <\/strong>e rischiava di essere una delle primissime vittime della tendenza, sempre più forte in Italia, a stringere la vite per addomesticare il sistema del gaming online<\/strong>.<\/p>

L'accusato <\/strong>è un giocatore qualunque a cui le forze dell'ordine avevano sequestrato l'iPhone<\/strong> per ragioni di controllo. Dalle successive indagini è emerso che l'uomo frequentava abitualmente casinò online<\/strong> non autorizzati dall'Amministrazione Autonoma dei Monopoli di Stato<\/strong>, ed è quindi scattato automaticamente il procedimento inquisitorio.<\/p>

L'avvocato Mario Ripamonti<\/strong>, legale che ha seguito la vicenda, ha immediatamente chiesto (e ottenuto) l'archiviazione per insussistenza di reato<\/strong>, data l'impossibilità di stabilire l'elemento relativo al \"luogo pubblico<\/strong>\". Il Codice Penale sentenzia, infatti, che \"Chiunque, in un luogo pubblico o aperto al pubblico<\/strong>, o in circoli privati di qualunque specie, tiene un giuoco d’azzardo o lo agevola è punito con l’arresto da tre mesi a un anno e con l’ammenda non inferiore a lire quattrocentomila<\/em>\".<\/p>

Una sentenza fondamentale<\/h2>

Aldilà di tutte le considerazioni di carattere giurisprudenziale, si tratta di una pronuncia di grande importanza in un periodo come questo, soprattutto se collegata al recente Decreto Balduzzi<\/strong>, di cui in questi giorni si è parlato moltissimo. Il suddetto Decreto, infatti, punta pesantemente il dito sull'utilizzo di mezzi telematici<\/strong> negli esercizi aperti al pubblico, ma cade in ovvie contraddizioni <\/strong>quando il limite fra legalità e illegalità si fa più labile.<\/p>

La storia è molto simile a quella che venne fuori quando, parecchi anni fa, ogni famiglia poté permettersi l'acquisto di un videoregistratore<\/strong>. Allora, la riproduzione di immagini protette da copyright divenne di uso comune e fu praticamente impossibile regolarizzarne i confini senza tirare in ballo i concetti di \"profitto<\/strong>\" e \"scopo di lucro<\/strong>\".<\/p>\n\n\n\n

Oggi si rischia di generare una confusione molto più grave, tanto che gli stessi operatori<\/strong> del settore non sanno in che modo accogliere le nuove normative. L'articolo 7<\/strong> del Decreto Balduzzi, infatti, sostiene che sia \"vietata la messa a disposizione, presso qualsiasi pubblico esercizio, di apparecchiature che, attraverso la connessione telematica, consentano ai clienti di giocare sulle piattaforme di gioco<\/strong> messe a disposizione dai concessionari on-line, da soggetti autorizzati all'esercizio dei giochi a distanza, ovvero da soggetti privi di qualsivoglia titolo concessorio o autorizzatorio rilasciato dalle competenti autorità<\/em>\".<\/p>

Prendendo tutto questo alla lettera, il proprio telefonino <\/strong>non rappresenta un'apparecchiatura messa a disposizione dall'esercizio pubblico e quindi a rigor di logica può essere utilizzato per giocare<\/strong>. L'impressione, in ogni caso, è che l'indeterminatezza delle attuali leggi in materia sia alla base dell'imbarazzo<\/strong> dei giudici nel dirimere casi come quello sopra citato.<\/p>

E' giusto, in ogni caso, far presente come l'Italia <\/strong>non sia la sola nazione a non essere ancora riuscita a sbrogliare la matassa <\/strong>del gaming online. Senza contare il recente Action Plan<\/strong> abbozzato cautamente dall'UE<\/strong>, sono tantissimi gli stati in cui le leggi che regolano il gioco stanno tentando faticosamente <\/strong>di adeguarsi alle nuove tecnologie.<\/p>

E non sempre con risultati troppo brillanti<\/strong>, se pensiamo che in America<\/strong>, nello stato di Washington<\/strong>, chi viene sorpreso a giocare a poker su internet si macchia di un crimine gravissimo<\/strong>, con pene detentorie equivalenti a quelle per reati come la pedofilia<\/strong>. Fanatici del proibizionismo? Mica tanto, visto e considerato che nello stesso stato hanno da poco legalizzato l'uso di marijuana a scopo ricreativo<\/strong>. Ma sarà sufficiente, secondo voi, a consolare i pokeristi che abitano da quelle parti?<\/p>
