{"id":20704,"date":"2012-11-20T13:00:00","date_gmt":"2012-11-20T13:00:00","guid":{"rendered":"https:\/\/www.pokerstrategy.com\/it\/poker-vs-lex-e-caos\/"},"modified":"2026-02-27T23:08:01","modified_gmt":"2026-02-27T23:08:01","slug":"poker-vs-lex-e-caos","status":"publish","type":"post","link":"https:\/\/www.pokerstrategy.com\/it\/news\/world-of-poker\/Poker-vs-lex-%C3%A8-caos_66280\/","title":{"rendered":"Poker vs lex: \u00e8 caos"},"content":{"rendered":"<?xml encoding=\"utf-8\" ?><p>Era il 2008 quando ad Altopascio, in provincia di <strong>Lucca<\/strong>, la <strong>Guardia di Finanza<\/strong> fece irruzione all'interno di un'associazione amatoriale di poker sportivo durante un torneo di Texas Hold'em con buy-in di &euro;20. I gestori del circolo dovettero aspettare addirittura <strong>3 anni<\/strong> per vedere riconosciute le proprie ragioni ed essere <strong>prosciolti<\/strong>. <\/p><p><img decoding=\"async\" src=\"https:\/\/www.pokerstrategy.com\/wp-content\/uploads\/cdn-origin\/2012\/11\/20\/chips600.jpg\" alt=\"chips\" width=\"250\" height=\"125\" align=\"right\" style=\"margin-left: 12px; margin-bottom: 6px;\">Non si trattava di una situazione nuova: gi&agrave; nello stesso anno, in provincia di <strong>Brindisi<\/strong>, un circolo era stato chiuso e successivamente riaperto grazie a una sentenza del <strong>Consiglio di Stato<\/strong>, che per anni rimase l'unico parere autorevole in una materia nella quale regnava il caos pi&ugrave; totale: il CdS <strong>permetteva l'organizzazione di tornei<\/strong> a patto che il <strong>buy-in massimo <\/strong>fosse di &euro;30, che non fosse permesso<strong> effettuare rebuy <\/strong>e che il premio spettante al vincitore <strong>non fosse erogato in denaro<\/strong>.<\/p><p>Di questa sentenza beneficiarono vari circoli privati, ad esempio il \"<strong>Double Up<\/strong>\" di <strong>Palermo<\/strong>, che nel 2010 si vide invaso dalle forze dell'ordine durante un freezeout da &euro;30, con la conseguente <strong>custodia cautelare<\/strong> per i 41 giocatori impegnati ai tavoli. A distanza di pochi mesi i giudici siciliani sentenziarono che nel poker sportivo \"<em>l'abilit&agrave; &egrave; un fattore preponderante rispetto all'alea<\/em>\" e ordinarono il <strong>dissequestro<\/strong>.<\/p><h2>Una sentenza destinata a ribaltarsi<\/h2><table border=\"0\" align=\"right\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"https:\/\/www.pokerstrategy.com\/wp-content\/uploads\/cdn-origin\/2012\/11\/20\/Prestige_Poker.jpg\" alt=\"Prestige Poker\" title=\"Prestige Poker Prato\" width=\"250\" height=\"188\" align=\"right\" style=\"margin-left: 12px; margin-bottom: 6px;\"><\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\"><font color=\"#888888\"><i>Il Prestige Poker di Prato<br><\/i><\/font><\/td>\n<\/tr>\n<\/tbody>\n<\/table><p>Nel frattempo la stessa sorte (denuncia e successiva archiviazione) toccava a numerose poker room della Penisola: da <strong>Genova <\/strong>a <strong>Massa<\/strong>, fino al<strong> Prestige Poker <\/strong>di <strong>Prato<\/strong>, che contava quasi 1500 iscritti. L'anarchia fu totale: alcuni gestori annunciarono la <strong>riapertura <\/strong>dei circoli precedentemente sequestrati, altri invece preferirono non rischiare ancora e mestamente abbassarono la saracinesca. Finch&eacute; la legge non decise di <strong>dissotterrare l'ascia<\/strong>.<\/p><p> La palma della sfortuna tocc&ograve; a un'associazione di poker sportivo di <strong>Bari<\/strong>, vittima del classico blitz delle forze dell'ordine durante un torneo di Texas Hold'em. Gli agenti misero i <strong>sigilli <\/strong>al locale e sequestrarono il <strong>montepremi <\/strong>(quasi &euro;5.000) che secondo gli organizzatori sarebbe servito ad acquistare i premi per i vincitori. Nonostante in teoria le linee guida del CdS fossero state rispettate, la <strong>Cassazione<\/strong>, questa volta, fu terribilmente severa, affermando che \"<em>il poker sportivo &egrave; un gioco basato prevalentemente sul caso<\/em>\" e che il reato costituisse materia non solo amministrativa, ma perfino penale.<\/p><p>La sentenza (datata 3 novembre 2011) sbugiard&ograve; totalmente quella, precedente, del CdS e costitu&igrave; il <strong>parere fondamentale per i verdetti successivi<\/strong>. L'associazione sportiva <strong>Fight Poker Club<\/strong>, di <strong>Roma<\/strong>, fu chiusa e sub&igrave; un durissimo procedimento che aggiunse ulteriori pezzi al puzzle. Nella fattispecie, fu interessante il punto di vista dei giudici, che sentenziarono in pratica come \"<em>tutti i circoli sportivi di poker live siano da considerarsi illegali a meno che non siano forniti di una specifica autorizzazione da parte dell'AAMS<\/em>\". Cosa complicatissima, visto che l'<strong>AAMS <\/strong>di concessioni non ne ha mai tirata fuori <strong>nemmeno mezza<\/strong>.<\/p><h2>Si moltiplicano i blitz<\/h2><p><img decoding=\"async\" src=\"https:\/\/www.pokerstrategy.com\/wp-content\/uploads\/cdn-origin\/2012\/11\/20\/jack.jpg\" alt=\"jack\" width=\"250\" height=\"141\" align=\"right\" style=\"margin-left: 12px; margin-bottom: 6px;\">Il resto &egrave; storia di oggi: sabato scorso a <strong>Sona <\/strong>(Verona), le <strong>Fiamme Gialle<\/strong> hanno fatto irruzione durante una sessione di poker e sequestrato un circolo che era in attivit&agrave; addirittura dal 2005. Le cose non si mettono bene per i gestori, dato che da alcune testimonianze risulta che le puntate al tavolo<strong> superassero anche i mille euro<\/strong>. Stessa sorte, ieri, per un'associazione di <strong>Volpiano <\/strong>(Torino), con l'irruzione degli agenti e 24 pokeristi sorpresi (e denunciati) durante un torneo di Hold'em da &euro;30.<\/p><p>Inutile dire che sono <strong>centinaia <\/strong>i circoli aperti in tutta Italia, nonostante la legge sia di parere apertamente contrario. Anche se le sentenze sono state finora controverse, &egrave; ovvio sostenere come<strong> tutte le associazioni di poker live in Italia siano da considerarsi illegali<\/strong> e rischino l'immediata chiusura.<\/p><h2>Uno spiraglio nel 2013?<\/h2><p>A questo punto, in un paese nel quale ormai il poker sportivo rappresenta una realt&agrave; fondamentale del <strong>patrimonio ludico popolare<\/strong>, urge una regolamentazione che consenta di capire entro quali limiti si possano prendere due carte in mano se non si &egrave; all'interno di <strong>casa propria<\/strong> o di un <strong>casin&ograve;<\/strong>. <\/p><p><img decoding=\"async\" src=\"https:\/\/www.pokerstrategy.com\/wp-content\/uploads\/cdn-origin\/2012\/11\/20\/livepoker.jpg\" alt=\"live poker\" width=\"250\" height=\"188\" align=\"right\" style=\"margin-left: 12px; margin-bottom: 6px;\">La situazione &egrave; tanto pi&ugrave; paradossale se si riflette sul fatto che una pratica <strong>considerata legale via internet non pu&ograve; essere penalmente perseguibile live<\/strong>. E fa sorridere l'idea che negli <strong>USA <\/strong>il problema sia rovesciato, visto che &egrave; consentito giocare live, ma in molti stati viene ritenuto un<strong> crimine anche grave<\/strong> il poker online. <\/p><p>La buona notizia (forse) &egrave; che il <strong>bando di regolamento<\/strong> per il mondo del poker live, in Italia, &egrave;<strong> in fase di costituzione<\/strong>. Anche se ormai da parecche settimane non ci sono notizie relative ai <strong>tempi di pubblicazione<\/strong>, tranne i soliti rumors che ritengono possa essere pronto <strong>entro febbraio 2013<\/strong>.
