Il tutto con tanto di <strong>multone <\/strong>per evasione fiscale. Ma il cittadino italiano protagonista di questa vicenda ancora in fasce non s'&egrave; perso d'animo e ha presentato <strong>ricorso <\/strong>alla <strong>Corte di Giustizia dell'Unione Europea<\/strong>. <\/p><p>Le sue ragioni? Quelle vincite erano<strong> gi&agrave; al netto<\/strong> della tassazione nel paese in questione, dunque per quale motivo pagare <strong>due volte<\/strong> per un reddito percepito una volta soltanto?<\/p><p>Ebbene, quello che &egrave; l'annoso dilemma che da tempo in Italia (ma non solo) divide <strong>Fisco <\/strong>e <strong>professionisti del poker<\/strong> potrebbe essere presto risolto dalla <strong>Corte di Giustizia Europea<\/strong>, che valutata la tesi difensiva del richiedente ha <strong>accolto il ricorso<\/strong> e nei prossimi mesi dovr&agrave; pronunciarsi sulla questione.<\/p><h2>Un precedente importante<\/h2><p>Si tratta di una vittoria di enormi proporzioni per il mondo del poker italiano, che oggi pi&ugrave; che mai vive in uno stato di <strong>caos burocratico<\/strong> dal quale sar&agrave; molto complicato venir fuori. Il <strong>Testo Unico delle Imposte sui Redditi<\/strong>, infatti, sentenzia che (<strong>art. 67<\/strong>) \"<em>le vincite di lotterie, concorsi [...] e giochi di abilit&agrave; vanno dichiarati alla voce 'redditi diversi'<\/em>\" e (<strong>art. 69<\/strong>) \"<em>costituiscono reddito per l'intero ammontare percepito nel periodo d'imposta, senza alcuna deduzione<\/em>\".<\/p><p> Pare abbastanza chiaro come questa legge fosse accettabile quando ancora non esisteva la <strong>professione del gambler<\/strong>, ma ora che i proventi del gioco sono per alcune persone una fonte di reddito in tutto e per tutto equiparabile a quella <strong>lavorativa<\/strong>, la mancata possibilit&agrave; di detrarre le spese (buy-in, viaggi, alberghi) suona come un'ingiustizia.<\/p><table border=\"0\" align=\"center\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"https:\/\/cdn-origin.pokerstrategy.com\/2013\/01\/08\/Tasse_2.png\" alt=\"tasse\" width=\"585\" height=\"283\" align=\"middle\" style=\"display: block; margin-left: auto; margin-right: auto;\"><\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\"><font color=\"#888888\"><i>In Spagna &egrave; gi&agrave; possibile detrarre dalle tasse le spese di gioco<br><\/i><\/font><\/td>\n<\/tr>\n<\/tbody>\n<\/table><p>Ma soprattutto suona come un'ingiustizia il fatto che le vincite occasionali ottenute in territorio estero subiscano oggi una <strong>doppia imposizione<\/strong>, il che significa che se mi trovo in vacanza in Croazia e vinco &euro;100.000 alla roulette dovr&ograve; pagare le tasse per intero sia al fisco croato che a quello italiano.<\/p><p>Le speranze sono tante, anche perch&eacute; c'&egrave; una sentenza favorevole di qualche anno fa, per il caso sollevato dalla signora finlandese <strong>Diana Elisabeth Lindman<\/strong>, che - vittima di una doppia imposizione per vincite effettuate in <strong>Svezia <\/strong>- dimostr&ograve; come la legge finlandese fosse contraddittoria e ottenne il \"s&igrave;\" della<strong> Corte Europea<\/strong>, la quale sentenzi&ograve; che (<strong>art. 49 Trattato CE<\/strong>) \"<em>Le vincite provenienti da giochi d'azzardo organizzati in altri Stati Membri dell'UE sono considerate come un reddito del vincitore e <strong>non sono imponibili<\/strong>\"<\/em>.<\/p><h2>E adesso?<\/h2><table border=\"0\" align=\"right\">\n<tbody>\n<tr>\n<td><img decoding=\"async\" src=\"https:\/\/cdn-origin.pokerstrategy.com\/2013\/01\/08\/perla-hotel-casino.jpg\" alt=\"perla\" width=\"250\" height=\"166\" align=\"right\" style=\"margin-left: 12px; margin-bottom: 6px;\"><\/td>\n<\/tr>\n<tr>\n<td style=\"text-align: center;\"><font color=\"#888888\"><i>Il casin&ograve; Perla di Nova Gorica. Sembra <br>che le slot qui siano molto generose...<br><\/i><\/font><\/td>\n<\/tr>\n<\/tbody>\n<\/table><p>Adesso bisogner&agrave; attendere qualche mese affinch&eacute; il caso venga preso in considerazione. Le sensazioni sono positive, anche perch&eacute; la <strong>CGE<\/strong> ha fatto chiaramente capire che il suo intento &egrave; quello di valutare solo dopo aver atteso <strong>un'altra sentenza fondamentale. <\/strong>Quella che la <strong>Commissione Tributaria di Trieste<\/strong> dovrebbe a breve esprimere circa la posizione di un cittadino veneto che aveva sub&igrave;to la classica doppia imposizione per i <strong>&euro;735.909,85<\/strong> vinti alle slot machine del casin&ograve; di <strong>Nova Gorica<\/strong> (beh... &egrave; anche vero che uno che vince quella somma tirando una leva per certi versi merita la multa!).<\/p><p>L'uomo ha gi&agrave; vinto in primo grado alla<strong> Commissione Provinciale di Gorizia<\/strong>. Difficile che la sentenza venga ribaltata. Grasso che cola per chi, giustamente, vorrebbe che venisse quantomeno fatta <strong>chiarezza<\/strong> nell'ambito di una situazione che di chiaro, per ora, ha poco o nulla.
