Aparentemente, o ju&iacute;z exarcebou os seus poderes e tomou uma decis&atilde;o que n&atilde;o se enquadra na sua &aacute;rea de jurisdi&ccedil;&atilde;o, de acordo com a iMEGA.<\/p><p>\n<br>\n<b><br>\nAqui ficam de forma resumida, os quatro pontos em quest&atilde;o:<\/b>\n<\/p><ul>\n<li>Uma vez que os dom&iacute;nios n&atilde;o estavam registados no Kentucky, nem sequer estavam fisicamente localizados no Kentucky, o estado do Kentucky n&atilde;o tem por isso qualquer responsabilidade sobre esses dom&iacute;nios.<\/li>\n<\/ul><ul>\n<li>\"O tribunal de Kentucky invadiu os poderes da Assemblei Geral de Kentucky e quebrou a doutrina da separa&ccedil;&atilde;o de poderes ao inglobar&nbsp; na defini&ccedil;&atilde;o dos estatutos de Kentucky sobre \"objectos de jogo\" os nomes de todos os dom&iacute;nios que foram visados.\" Por outras palavras, a iMEGA afirma que o tribunal excedeu claramente os seus poderes ao tentar criar uma lei por vias judiciais, em vez de ter sido por ordem legislativa.<\/li>\n<\/ul><ul>\n<li>A parte respons&aacute;vel original, o Secret&aacute;rio de Estado do Kentucky J. Michael Brown, n&atilde;o tinha a autoridade suficiente para iniciar este tipo de ac&ccedil;&atilde;o.<\/li>\n<\/ul><ul>\n<li>Uma vez que as alegadas ac&ccedil;&otilde;es de viola&ccedil;&atilde;o dos estatutos penais do Kentucky ocorreram todas fora do Kentucky, o estado n&atilde;o tem por isso qualquer jurisdi&ccedil;&atilde;o sobre o caso.
