I initially heard that the Elephant is free, but then I heard it's not working any more. So, can I get it in the end ?

Nope. Poker Elephant doesn't work anymore.
You can download the trial versions of PokerTraker 3 or Holdem Manager 2. I use PT 3 and I'm pleased by it.

PokerStrategy Elephant was discontinued a few months back. Please see our software section for your available options 
As ninuu pointed out there are free trials available out there for PokerTracker and Holdem Manager
