AGCC: Full Tilt Poker's License Still Valid
Even though the AGCC suspended Full Tilt Poker's primary license back on June 29th, they are still considering it to be valid. As a result, Kahnawake Gaming Commission has renewed Full Tilt Poker's secondary license for two more years.
On Friday, the Kahnawake Gaming Commission released a statement in which they have agreed to renew Full Tilt Poker's Secondary Client Provider Authorization (CPA) for two more years.
The KGC justified their decision by arguing that Full Tilt Poker's license is still valid:
"To maintain a Secondary CPA, a licensee must maintain a valid licence to operate interactive gaming that has been issued by a comparable jurisdiction (the "primary jurisdiction").
Accordingly, the Commission is closely monitoring the proceedings being conducted by the Alderney Gambling Control Commission (the "AGCC") concerning the eGambling Licences held by Filco Limited, operating as "Full Tilt Poker". The AGCC has confirmed to the Commission that, although the eGambling Licences held by Filco Limited are presently suspended pending the outcome of a hearing, "these licences are still considered to be valid."
Full Tilt Poker has held this secondary license since 2010, and we presume it is basically a backup, so that if the servers in Alderney fail, the service can be switched to Kahnawake.
It is still unclear whether a renewal of a secondary CPA would allow Full Tilt Poker to restart business under Kahnawake regulations, and even so, if Full Tilt Poker would want to resume operations once the renewal is in place. Even though Full Tilt Poker's license is still considered to be valid, it is very unlikely that Alderney would let them start up their business again, even through a secondary license.
Back on June 29th, when Alderney first released a statement announcing the suspension of Full Tilt Poker's licenses, it clearly stated that the four companies behind Full Tilt Poker licensed by the AGCC must "cease to register new customers, accept deposits from existing customers, allow existing customers to withdraw funds that are held in their accounts, and permit customers to participate in any form of poker game play or gambling transaction."
