The problem exists. Because you can export your hand histories from your tracker and import any hand history there, it is very difficult or even impossible to prevent that from happening. It is possible that when you face an unknown player, he actually has a lot of hand from you and has some accurate HUD stats. That is quite unfair, I agree with you there.

Yes the problem does exist since a very long time, actually plenty websites and even some forums do those kind of offers.
On the legal side i think with European new legislations about data privacy / protection it could be considered as illegal and pples could engage legal actions against those websites & offers depending on the localisation of those sites.
On the international side there is nothing much that can be done.

We could also extend that debate to for exemple live streams, players at a table didn't explicitly agree to allow other peoples to watch their game / nicknames / HUD stats.

The conter argument to that is when you play poker you can observe any tables without having to play so you implicitly agree to let others watch your game.
And if so you can probably also extend it to DB of hand histories sold online by 3rd parts and some players to other players.

I'm not a lawyer but in my opinion it's on the grey line unless like i said from the european legislation side then it would be more like the orange/red line.

But I just wonder how is that even possible from those sites to get those hand histories when it comes to ZOOM games? Or zoom games are safe from this actions? I ask because I basically play only zooms and that makes no sense to me at all because you can not spectate a zoom games right?

Since i don't play ZOOM games i cannot help you much on that side or give a clear answer about it.
Maybe la55i or an other Mod can answer you about ZOOM more specificly.
But if you play ZOOM using a HUD you will automatically gather data on other players when you in a hand and if you play regulary on a high volume
you will gather more and more data about regulars of the game. For recreational players i don't think those data can be relevant
since mostly you won't cross their path often enough to have enough hands but it's just in my opinion. some argue 10 hands are enough to have basic reads.
Others will say 100 Hands , and some will say 1K hands or more ... Nothing is wrote in stone , not even strategies.

Its not like I am up to purchase those I just wonder if playing zoom your data are safe since there is no possibility to spectate zoom tables like regular cash games.

I'm an internet paranoid so i always assume that my data are never 100% safe anywhere.
But i think zoom gives less informations away to trackers unless you do play very regulary, high volume and against the same kind of regulars.

as far as i know, stars did something with their software at some point a few years ago, and since then there are no services that sell zoom hands anymore.
i know that there are some reg groups that share hands, but that's about it. i don't do it

I have no idea how these things work but I do play zoom and I could sell you half a million zoom hands right now. I could also upload those to a site that sells them forward. Ofc I'm not going to do that but nothing would stop me. So I don't know why you wouldn't be able to buy zoom hands.

When you just spectate, you will not get the recorded hand history file anyway, so whether you can spectate or not shouldn't make a difference.

If you want to be safer, play on sites where the tables are anonymous or where you can change your nickname frequently. Of course if you are using a HUD that gives you a disadvantage too.

Also the traffic of players might be much lower on those ones.
