I think he is a laggy short stackers who takes down a lot of pots pre with 3bets or shove.

Flatting A9s pre on the SB is a bad idea in general. Hand plays well postflop yes, but will be dominated vs his range and you are OOP, which means you can't realize your equity easily, you'll have to turn up aggression postflop vs a heavy range on certain spots (like this one). And the BB can always squeeze/call.
3betting is better for sure. Folding is fine and I believe it is the most frequently play.
Besides, in this case you're playing 50bb effective which decreases the implied odds you need to play a hand like A9s.
Flop check/raise fine. I'm sure he overcbets this type of boards where he should be doing a lot (really, a lot) of checking.
Turn he has 37.43bb left, so the only option OTT is put him all-in and apply maximum pressure.
I doubt he folds overpairs, but you cannot check and give up once you check/raise flop. Load the gun and fire in the hole.
