Ist eine Firma aus New York, quasi ein Marktplatz für Ansprüche gegenüber insolventen Kryptoplattform.
Man kann einfach seinen Anspruch darüber verkaufen und erhält den Prozentsatz seiner Roll als Cash. Die Raten zeigen halt die Erwartung der Auszahlungsquote an.
Letzten Monat war die Binance Versicherung bei 0,5% pro Monat, die BUSD News haben hier wohl einen Effekt gehabt. Über Nexus ist ja keine Absicherung für Binance zu bekommen im Moment.

We are aware that due to the international nature of the FTX.com exchange, many customers and creditors of FTX Digital prefer to communicate in languages other than English. First Interim Report of the Joint Provisional Liquidators
Since the previous communication sent on or around 6 January 2023, the JPLs have filed their first interim report to the Supreme Court of The Bahamas (“Supreme Court”). This interim report provides a detailed account of the work performed by the JPLs, and on their behalf, over the first three months since their appointment. This report is available to view on the case website ( https://www.pwc.com/bs/fdm).
Chapter 15 Recognition of the Provisional Liquidation in the United States
At a hearing on 15 February 2023 the JPLs were successful in their application to the Delaware Bankruptcy Court for recognition under Chapter 15 of the US Bankruptcy Code. Under the terms of the Recognition Order granted, the Provisional Liquidation in the Supreme Court is recognised as the foreign main proceeding for FTX Digital and the JPLs as Foreign Representatives for the purposes of the US Bankruptcy Court. A copy of the order has been posted on the case website.
Application for Directions on matters central to the Provisional Liquidation of FTX Digital
The JPLs are faced with a number of legal questions that are central to determining the appropriate approach to the Provisional Liquidation of FTX Digital. Accordingly, the JPLs consider it appropriate to seek directions from the Supreme Court on how these matters should be determined. In this regard, on 15 March 2023 the JPLs filed an application requesting the Supreme Court's permission for the JPLs to seek confirmation from the Delaware Bankruptcy Court that the proposed Directions Application that the JPLs wish to issue in the Supreme Court as soon as possible does not breach the automatic stay in the Chapter 11 proceedings, or to the extent that it does, to grant relief from the stay in order that there is no risk of the JPLs being accused of breaching US Bankruptcy law.
The proposed Directions Application seeks directions from the Supreme Court on the following issues:
1. The parameters of the FTX Digital Estate
2. The rights and obligations of the JPLs in relation to FTX Digital
3. Who are FTX Digital’s customers
4. The nature of the rights and obligations of FTX Digital’s customers
5. The relationship of customers of FTX Digital to each other, to other creditors and stakeholders of FTX Digital
Immediately after the Directions Application has been issued, the JPLs will seek preliminary directions from the Supreme Court on the procedure for determining the issues in the Directions Application, including making orders for representatives of stakeholders of FTX Digital (customers, creditors and others) to appear and make representations to the Supreme Court on the issues raised by the Directions Application. There will also be an opportunity for the representatives to file evidence, if so directed by the Supreme Court. We will write further to update you after the Directions Application has been issued.
Registration of details on the FTX Digital Claims Portal
Customers who believe that they have fiat or digital assets in their name on the FTX.com exchange are encouraged to register their details on the claims portal to allow for future contact by the JPLs and to be kept informed of developments. Registration is recommended for customers who wish to ensure that the JPLs have your current contact information, receive updates on the status of the Provisional Liquidation, obtain copies of our progress reports, attend meetings (as appropriate) and, when required, submit a claim for any fiat or cryptocurrency owed to them. Third party claimants (i.e. non-customer creditors including suppliers and vendors) against FTX Digital are also encouraged to utilise the registration facility on the portal.
At this stage the creditor portal has been deployed solely to capture creditor and customer contact details, which will be held securely and kept confidential by PwC on behalf of the JPLs and FTX Digital. In the coming weeks the portal will progress through the remaining stages of the claims process outlined on the portal homepage, with the next step allowing users to create log-in credentials to access their own personalised landing page which will be used to communicate updates from the JPLs as further information comes to hand and, when appropriate, submit claim details and supporting information.

FTX EU Operations
FTX EU Ltd. is a European CySEC-supervised Investment Firm operating under the highest regulatory standard in the European Union offering derivatives trading under MiFID II. FTX EU Ltd. operated independently from the international platform to a large extent. One of the most important consequences of being MiFID-II-regulated is that client fiat funds must be kept segregated in legally protected bank accounts. In addition to that, we took some more measures to effectively protect clients funds and mitigate counterparty risk that eventually materialized. We even went beyond what the law requires from an investment firm.
Closing of Positions on 12 November 2022
When the platform shut down on 12 November 2022, it was and still is unclear whether the derivatives offered by FTX EU Ltd. (previously K-DNA Financial Services Ltd) were hedged by the respective underlying on the FTX.com platform. Therefore, FTX EU Ltd. has decided - in accordance with its Terms of Service and acting at all times in the best interests of its clients and after discussion with CySEC - to close all clients' positions and settle in EURO in order to avoid any downside market risk for the clients. Therefore, your FTX EU account only shows the EURO balance as of 12 November 2022, 3:28:48 UTC. You will also find the closing price list on the website.

ich (männl., 43 Jahre aus Oberfranken) habe mich tatsächlich nur wegen diesem Forum und genau diesem Thread angemeldet. Freundlicherweise wurde mir sofort der Bronze-Status gegeben, um mich hier einbringen zu können. Kurzum: Poker spiele ich nicht, aber wer weiß ;-)
Nun gut, ich schreibe eben genau wegen dem Thema „FTX“. Leider gehöre ich auch zu den Leidtragenden die hier Geld zunächst einmal verloren haben (nicht FTX EU). Ich hatte noch Glück, irgendwie kam ich eine Woche vor der Insolvenz auf die Idee, alle gehaltenen Krypto-Coins auf Coinbase zu verschieben und zukünftig nur die „Aktien-Anteile“ bei FTX zu belassen. Grund: einfach nur so! So blieben dann bei FTX nur ein kleiner Teil übrig (ca. 5T€). Aber trotzdem, Mist !! Nach kurzem Lächeln eines Anwalts habe ich das Geld als Lehrgeld abgeschrieben. Trotzdem verfolge ich natürlich im Wochenrhythmus die News zu diesem Thema. Und so bin ich auf dieses Forum gestoßen. Es scheint mir, dass es nur sehr wenig deutschsprachige Infos gibt und auch wenig Diskussionsrunden. Umso mehr freut es mich diesen Thread gefunden zu haben. Aktuell hab ich auch die ein oder andere Email bekommen und bin eigentlich auf dem gleichen Stand wie ihr. Daher würde ich mich sehr freuen, wenn man diesen Thread weiter pflegt und hier von wichtigen Neuigkeiten, Terminen oder Schritten berichtet. Ich würde mich sehr gern daran orientieren. Und vielleicht ist es ja dem ein oder anderen eine weitere Hilfe, wenn das Thema hier aktuell gehalten wird. So nun genug geschrieben, Euch viel Glück beim Pokern und immer ein gutes Blatt. mein Claim ist jetzt in den USA eingegangen und zur Kenntnis genommen worden.
Hatte den Fall ja zur Anzeige gebracht, wie erwartet wurde das Verfahren von der Staatsanwaltschaft eingestellt.
Viel mehr gibt es aktuell nicht zu tun. Denke das Verfahren wird sicher etliche Jahre dauern.
Bereue nur, dass ich meine Stablecoins dort nach dem Stop der Auszahlungen nicht in BTC getauscht habe.

Wie Du schreibst hast Du einen Brief erhalten, dass Dein Claim eingegangen ist. Hast Du zusätzlich noch mal einen Brief in die USA geschickt mit der Aufforderung zu Auszahlung.
Ich habe ja die Email erhalten mit dem Inhalt: „Your Scheduled Claim Information and Unique Customer Code“. In dieser Email wurden die Vermögenswerte korrekt aufgelistet. Meinst Du das ist ist OK ? Tatsächlich habe ich an anderer Stelle gelesen, man solle einen formlosen Brief verfassen mit entsprechendem Inhalt (inkl. einen frankierten Rückumschlag mit US Briefmarke).
Noch eine andere Frage, alle meinen ja, dass das Verfahren Jahre dauern wird. Bin ja der gleichen Meinung. Aber was ist wenn die Börse tatsächlich im Sommer (wird ja teilweise gemunkelt) wieder öffnet - fangen die dann dort bei Null an. Oder aber hat man wieder vollen Zugriff auf seinen Account inkl. Guthaben?

ich habe einen Brief mit Rückumschlag geschickt, das ist aber keine Aufforderung zur Auszahlung sondern erstmal nur die Anmeldung meiner Forderung beim Insolvenzverwalter. Ich würde auf jedenfall empfehlen die Forderung anzumelden, vielleicht ist es auch überflüssig aber das Formular ist ja nicht allzu schwierig auszufüllen. Rückumschlag kannst dir sparen, bei mir haben sie damit nichts zurückgeschickt obwohl ich alles korrekt vorbereitet hatte.
Das man Zugriff auf seinen Account inkl. Guthaben haben sollte wird nicht passieren, das Geld ist ja einfach nicht da. Zu der Wiedereröffnung habe ich keine Infos, bezweifle aber dass es dazu kommt.

ja das isses. wenn du irgenwelche screenshots von deiner balance kurz vor dem shut down hast einfach mitschicken. dauert ein paar wochen bis du ne schriftliche antwort bekommst. unter https://restructuring.ra.kroll.com/FTX/Home-ClaimInfo werden ca ein mal die woche die liste der gläubiger (anonym) aktualisiert, aber wenn du eine krumme summe angegeben hast (z.b. $5127,82), dann weißt du gleich dass du dabei bist.
- muss ich irgendwas tun obwohl meine balance in der ersten email richtig erfasst angezeigt wurde? (es waren selbst letzte shitcoins bis 10stellen nach komma richtig...)

das hatte ich mich auch gefragt... aber mein Grundgedanke ist, je mehr desto besser. Zusätzlich hat Alaton das nochmal bestätigt. Aktueller Stand bei mir:
30.03.23 Email bekommen mit Betreff "Your Scheduled Claim Information and Unique Customer Code".
In dieser Email wurde meinem Account/Person eine eindeutige Nummer zugewiesen und eine Auflistung meiner Guthaben (also in Form von Coins und Aktien usw.). Diese Liste wahr erstaunlich korrekt. Die Nummer ist dann hier aufgelistet: https://media.ra.kroll.com/ftx/schedules/1/FTXSchedules.html

Also auch die Email von PwC. Hier habe ich mich entsprechend eingetragen.
Zusätzlich geht diese Woche der Brief raus (warte noch auf eine US-Briefmarke für Rücksendeumschlag), mit dem Claim Formular inkl. Kopien von Kreditkartenabrechnungen und den Bestätigungsmails von FTX über den Geldeingang (hatte ich alles gespeichert). Interessant ist es allein deswegen schon, weil man den Verlust, so wie ich das lese, von der Steuer absetzen kann.
Aktuell kann man mehr glaube ich nicht tun.

Absetzen kann man den Verlust in der Regel erst wenn die genaue Quote feststeht, d.h. potenziell in etlichen Jahren. Und ob dann noch entsprechende Gewinne vorhanden sind um es gegenzurechnen ist fraglich. Aus dem Grund kann ein Verkauf der Forderung auch sinnvoll sein. Wie der eventuelle Zugewinn bei höherer Quote als beim Verkauf festgelegt dann zu versteuern ist, kann ich in dem Fall nicht beantworten.

Absetzen kann man den Verlust in der Regel erst wenn die genaue Quote feststeht, d.h. potenziell in etlichen Jahren. Und ob dann noch entsprechende Gewinne vorhanden sind um es gegenzurechnen ist fraglich. Aus dem Grund kann ein Verkauf der Forderung auch sinnvoll sein. Wie kann man sich das vorstellen mit dem "schuldschein" verkaufen an Verwandte? Kannst du das ab einem Bsp mit 1k erklären? Marktpreise 20cents on the dollar. Kauft man den schuldschein später wieder zurück? Und geht das auch mit der Partnerin?^^

Ich hab einen 3-seitigen Vertrag aufgesetzt und den Anspruch ggüber FTX damit verkauft. Ist ja einfach ein normaler Kauf-/Verkauf. Laut meinem Steuerberater kein Problem.
Ob du das später zurückkaufen willst kommt ja auf die Umstände an. Sollte auch mit Ehepartner gehen, sehe ich auf den ersten Blick keine Probleme. Wenn man den Wert halt zu hoch oder zu niedrig ansetzt kann das Finanzamt eventuell argumentieren es wäre eine Schenkung o.ä..
Hab jetzt übrigens doch auch meinen Antrag von denen gestempelt zurückgeschickt bekommen. Damit bin ich jetzt auch erstmal zufrieden.
